📜 Agreement to Terms

By accessing or using the Chefie mobile application ("App", "Service", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

Must be 13 or older: You must be at least 13 years old to use Chefie. By using the Service, you represent that you meet this requirement.

If you are under 13: If we discover that a user is under 13, we will immediately terminate their account and delete all associated data. Parents or guardians can request deletion of a minor's account by emailing chefieInfo@gmail.com with subject line "Minor Account Deletion Request."

🍳 Description of Service

Chefie is an AI-powered meal planning and kitchen management application that provides:

Personalized meal plan generation
Recipe import and management
Pantry inventory tracking
Smart shopping list generation
AI-powered recipe parsing and suggestions
Artisan recipe and cocktail creation features

The Service uses artificial intelligence (Google Gemini AI) to generate meal plans, parse recipes, and provide personalized recommendations.

Our Content

The Chefie app, including its design, code, graphics, logos, and original content, is owned by Chefie and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

Your Content

You retain ownership of recipes, notes, and other content you create in Chefie ("User Content"). However, by submitting User Content, you grant us a non-exclusive, worldwide, royalty-free, perpetual license to:

Store, display, and transmit your content to provide the Service
Create backups and copies for technical purposes
Use anonymized, aggregated data to improve our AI and Service

You represent that you have the right to submit any User Content and that it does not infringe on third-party rights.

AI-Generated Content Ownership

Content generated by our AI (meal plans, recipes, suggestions) is provided "as-is" for your personal use. We make no ownership claims to AI-generated content, but we also provide no guarantees regarding:

Originality or uniqueness of AI outputs
Your ability to claim exclusive rights to AI-generated content
Whether AI outputs may resemble existing copyrighted works

You use AI-generated content at your own discretion and risk.

👤 User Accounts

Account Creation

You must provide accurate and complete information when creating an account
You are responsible for maintaining the security of your account and password
You must immediately notify us of any unauthorized use of your account
You may not use another person's account without permission

Account Termination

You may delete your account at any time through the app settings
We reserve the right to suspend or terminate accounts that violate these Terms
Upon termination, your data will be deleted in accordance with our Privacy Policy

✅ Acceptable Use

You May:

Use the Service for personal, non-commercial purposes
Create and share recipes using the provided sharing features
Import recipes from publicly available sources
Generate meal plans based on your preferences and dietary restrictions

You May Not:

Use the Service for any illegal purpose
Violate any laws in your jurisdiction
Infringe on intellectual property rights of others
Attempt to gain unauthorized access to our systems
Upload malicious code, viruses, or harmful content
Use automated systems (bots, scrapers, crawlers) to access the Service
Resell, redistribute, or commercialize the Service
Systematically scrape, harvest, or collect AI-generated content for commercial purposes
Use AI outputs to train competing AI models or services
Create derivative products or services based on bulk AI-generated content from Chefie
Circumvent usage limits, quotas, or rate limiting mechanisms
Share account credentials or allow others to access your subscription
Misrepresent your identity or affiliation
Interfere with or disrupt the Service or its infrastructure

Important Disclaimers

No Warranties on AI Output:

AI-generated meal plans and recipes are suggestions only
We do not guarantee accuracy, safety, or suitability
Always verify nutritional information independently
Consult a healthcare professional for medical dietary advice

Allergy and Dietary Restrictions:

While we strive to respect your dietary preferences and allergies, AI may make mistakes
ALWAYS double-check ingredients if you have severe allergies
We are NOT responsible for allergic reactions or health issues

💰 Pricing, Subscriptions, and Payments

Subscription Tiers

Chefie offers the following subscription options:

Free Chefie: Basic features with weekly usage limits
Sous Chefie ($4.99/month or $44.99/year): Expanded AI usage and additional features
Super Chefie ($9.99/month or $89.99/year): Full access to all features including Artisan recipes and Mixologist

Billing

Subscriptions are billed in advance on a recurring basis (monthly or annually)
Payment is processed through Apple App Store or Google Play Store
Prices are in USD and may vary by region due to currency conversion and local taxes
We reserve the right to change subscription prices with 30 days advance notice

Free Trials

We may offer free trial periods. At the end of a trial, your subscription will automatically convert to a paid subscription unless you cancel before the trial ends.

Cancellation

You may cancel your subscription at any time through your device's app store settings (Apple App Store or Google Play Store)
Cancellation takes effect at the end of your current billing period
You will retain access to paid features until your current period expires
We do not provide partial refunds for unused portions of a subscription period

Refunds

Refund requests are handled by Apple or Google, not directly by Chefie:

iOS: Request refunds through Apple at reportaproblem.apple.com
Android: Request refunds through Google Play Store within 48 hours of purchase, or contact Google Play support

We cannot process refunds directly. All refund decisions are at the discretion of Apple or Google.

Downgrade and Cancellation Effects

If you downgrade or cancel, your data (recipes, inventory, meal plans) will be preserved
Access to premium features will end when your paid period expires
Usage limits will revert to your new tier's limits
You can upgrade again at any time to restore premium access

Price Changes

If we change subscription prices:

We will provide at least 30 days advance notice via email and in-app notification
Price changes will apply to your next billing cycle after the notice period
You may cancel before the new price takes effect

Chefie uses third-party services, including:

Google Gemini AI - For generating meal plans and parsing recipes
Google Cloud Platform - For hosting and data storage
Supabase - For user authentication and data synchronization
Apple App Store / Google Play Store - For subscription billing and payment processing
Firebase - For analytics and push notifications

Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party services.

AI and Data Improvement

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

The Service will meet your requirements
The Service will be available at all times
AI-generated content will be accurate or safe
Data will never be lost (though we make reasonable efforts)

⚖ Limitation of Liability

Exclusion of Indirect Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY:

Indirect, incidental, special, consequential, or punitive damages
Loss of profits, revenue, data, use, goodwill, or other intangible losses
Damages resulting from unauthorized access to or alteration of your data
Damages resulting from any third-party conduct or content
Damages resulting from AI-generated content, including recipe errors, nutritional inaccuracies, or allergen omissions

Liability Cap

OUR TOTAL CUMULATIVE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF:

The total fees you paid to us in the 12 months preceding the claim, OR
One hundred US dollars ($100 USD)

Specific Exclusions

Without limiting the above, we are specifically not liable for:

Food allergies or allergic reactions from following recipes or meal plans
Health issues arising from dietary information or suggestions
Recipe failures, food spoilage, or cooking accidents
Data loss due to technical failures or account termination
Errors in AI-generated nutritional information or ingredient lists

These limitations apply regardless of the legal theory (contract, tort, strict liability, or otherwise), even if we have been advised of the possibility of such damages.

Medical Disclaimer

Chefie is NOT a medical device or health application
Do not use Chefie for medical nutrition planning
Consult healthcare professionals for dietary medical advice
We are not liable for health issues arising from meal plans or recipes

🌎 Export Controls and Sanctions

You agree to comply with all applicable export and import control laws and regulations. You represent that you are not:

Located in a country subject to U.S. government embargo
Listed on any U.S. government list of prohibited or restricted parties
Using the Service for prohibited end-uses (military, weapons, etc.)

⚖ Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of California, without regard to its conflict of law provisions.

Informal Resolution

Before filing a claim, you agree to contact us at chefieInfo@gmail.com to attempt informal resolution.

Class Action Waiver

You agree to resolve disputes individually, not as part of a class, consolidated, or representative action.

📝 Changes to Terms

We may modify these Terms at any time. We will notify you by:

Posting updated Terms in the App
Updating the "Last Updated" date
Email notification for material changes

Continued use after changes constitutes acceptance of new Terms.
